1. Preamble
These Terms and Conditions of Sale (hereinafter the “T&Cs”) apply to all sales concluded on the website d-moris.com (hereinafter the “Website”), operated by MR Composites (hereinafter the “Seller”).
The Website is a Shopify e-commerce platform specializing in the sale of composite body parts.
2. Acceptance of the T&Cs
Any order placed on the Website implies full and unconditional acceptance of these T&Cs by the Customer.
The Customer declares that they are of legal age and have the legal capacity to enter into a contract.
3. Products
D.Moris products are composite body parts requiring preparation and finishing work carried out by a professional body shop specialist.
3.1. The products offered for sale are parts intended for motor vehicles. They are described and presented as accurately as possible on the Website. However, photographs and graphics are non-contractual and shall not engage the Seller’s liability.
3.2. The essential characteristics of the products are described as accurately as possible. However, the Seller shall not be held liable for any errors or omissions.
3.3. The Seller reserves the right to modify the product range at any time without prior notice.
3.4. Unless otherwise stated, all products sold by the Seller are new and comply with applicable European legislation and French standards.
3.5. Composite body parts may present slight variations in color, texture, or finish compared to the visuals displayed on the Website. These variations are inherent to the manufacturing process and do not constitute a defect.
3.6. The Customer is responsible for verifying product compatibility with their vehicle before purchase. While compatibility information is provided, the Customer is advised to consult a professional if in doubt.
3.7. Some products may require adjustments during installation. This information is specified in the product description where applicable. The Seller shall not be held responsible for any additional costs related to such adjustments.
3.8. Products must be used in accordance with manufacturer specifications and industry standards. Any improper use is the sole responsibility of the Customer.
3.9. The Seller reserves the right to discontinue or modify any product at any time. Orders already placed will be fulfilled.
3.10. Certain products may offer customization options. Delivery times may be extended for such products, and they are non-returnable and non-exchangeable except in the case of a manufacturing defect.
3.11. “Ready-to-paint” parts
Parts are delivered “ready to paint,” which implies:
- Mandatory test fitting prior to any preparation, modification, or painting
- Possible adjustments: sanding, fitting, trimming mold edges, minor filler or fiber corrections
- Potential appearance of slight imperfections during sanding, which is normal for composite parts
- The Seller shall not be responsible for labor costs related to these standard adjustments
3.12 Mandatory test fitting
Before any work is carried out (preparation, cutting, drilling, or painting), the Customer must perform a full test fit to ensure compatibility with the vehicle.
In case of any issue, the Customer must contact D.Moris before making any modification.
No return will be accepted if the part has been fitted, modified, sanded, drilled, or painted.
4. Prices
4.1. Prices are indicated in euros, excluding taxes and shipping costs.
4.2. The Seller reserves the right to modify prices at any time. The price applicable is the one in effect on the day of the order.
5. Orders
5.1. The Customer confirms the order by clicking “Confirm order” after accepting these T&Cs.
5.2. Any order implies acceptance of product prices and descriptions.
5.3. The Seller reserves the right to refuse an order in case of unavailability, supply issues, or previous disputes.
6. Payment
6.1. Payments are made using the methods offered on the Website.
6.2. Orders are considered final and processed only after full payment is received.
7. Delivery
7.1. Shipping quotes are valid for 7 days from issuance.
7.2. Products are delivered to the address provided by the Customer.
7.3. Manufacturing, shipping and delivery times
All D.Moris products are made to order using high-quality composite manufacturing processes.
Manufacturing and shipping times are provided for indication only. The average lead time is 4 to 6 weeks from final order validation, including full payment.
This timeframe may vary depending on:
- product complexity
- quantities ordered
- level of customization
- production workload
- external factors beyond the Seller’s control (supplier delays, logistics constraints, force majeure, etc.)
D.Moris will inform the Customer as soon as possible in case of significant delay adjustments.
These timeframes do not constitute a firm delivery commitment. Therefore, no reasonable delay shall give rise to:
- order cancellation
- refusal of delivery
- payment withholding
- compensation or penalties
Delivery is deemed completed once the goods are handed over to the carrier.
8. Right of withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalized.
All products are made to order according to Customer specifications. Therefore, no returns, exchanges, or refunds will be accepted except in the case of proven defect or non-conformity.
It is the Customer’s responsibility to carefully check order details before validation.
9. Warranty
9.1. Products benefit from legal warranties of conformity and hidden defects under French law.
9.2 Warranty exclusions
No warranty applies in the following cases:
- modified or painted parts
- absence of test fitting
- incompatibility with modified, repaired, or damaged vehicles
- incorrect product selection by the Customer
10. Liability
10.1. The Seller is bound by a best-efforts obligation in the online sales process.
10.2. The Seller shall not be liable for damages resulting from improper use of products.
10.3. Products must be installed by qualified professionals. The Seller is not liable for improper installation.
10.4. The Customer is solely responsible for product selection, storage, and use.
10.5. The Seller is not liable for issues related to internet use (data loss, intrusion, viruses, etc.).
10.6. The Seller shall not be liable in case of stock shortages, force majeure, or disruptions in transport or communication services.
10.7. In any case, the Seller’s liability is limited to the amount of the order.
10.8. The Customer must comply with applicable regulations, including road safety standards.
10.9. The Seller is not responsible for non-professional installation, vehicle modifications, labor costs, or improper use.
10.10. Technical information provided on the Website is indicative only.
10.11. In case of proven defect, liability is limited to replacement or refund of the defective product.
11. Intellectual property
11.1. All elements of the Website remain the exclusive intellectual property of the Seller (models, molds, photos, texts, designs).
12. Personal data
12.1. Customer data is processed and stored for order management purposes.
12.2. In accordance with applicable data protection laws, Customers have the right to access, modify, and oppose their personal data.
13. Applicable law and disputes
13.1. hese T&Cs are governed by French law. In case of dispute, French courts shall have exclusive jurisdiction.
